Judge Advocate offers
insights into
'Your Responsibility'
By Art Lustig
Department Judge Advocate
Somehow or other, over the many years since 1919, a
fiction has grown up concerning the operation of a
Post canteen. In reviewing Post Constitutions and
Bylaws and questioning the operation of the
clubroom, bar, canteen
the inappropriate
response is usually something like, "The canteen is
no part of the American Legion Post." No matter
what one may wish to believe, a Post that has a
canteen, a bar, or whatever you choose to call it,
the canteen is a part of the Post. It is owned by
the Post, administered by the Post, maintained by
the Post, financed by the Post, and ultimately
sustains the losses or reaps the benefits. You can,
if you wish, call a horse a cow; however, no matter
what you call it, it is still a horse.
The operation of the facility should be of prime
importance to its members so that it always will be
in conformity with the laws of the State of Ohio as
well as the community in which the Post is located.
Of utmost importance is the character and training
of its employees and/or volunteers. They, as well
as their customers, are what truly reflect the
American Legion Post in which they work; but it is
you, the member of the American Legion, who has
ultimate responsibility not only for the manner in
which the canteen is operated, but by the manner in
which you comport yourself within the Post.
The following, which was taken from a notice to
the membership of a similar organization is
certainly on point.
A MEMBER RESPONSIBILITY
We (The American Legion Post) are in the
business of providing excellent service and
customer care to our members. In the event that a
server or bartender deems it necessary to refuse
service to any member or guest, we ask that the
member realize that the request is not a punishment
but a protection to both the member and the Club
(Post). This is always a delicate situation but one
that we take very seriously. Please understand that
as service professionals, we occasionally find
ourselves in the awkward position of having to say
no to a member and we ask your understanding and
cooperation.
In short, whoever runs the bar, whatever
committee may write the rules and regulations,
whichever officer may be in charge, the success or
failure of your Post Canteen ultimately rests with
none other than you. It is your responsibility.
